Elbridge (WSYR-TV) - The two Elbridge men facing rape and separate animal cruelty charges were back in town court today.

Police say 20 year old Dustin Gauger and 18 year old Kyle Custer stole a cat, doused it in gasoline, and set it on fire, killing the cat.

The investigation into that crime led to the men also being charged with second degree rape.

They are accused of having sex with two 14 year old girls.

The teens came forward after their parents learned of the animal cruelty charges against Gauger and Custer.

Today both defendants waived their right to a preliminary hearing on the cruelty charges.

On the rape charges: Gauger's case has been waved to a grand jury. Custer's case was not. He will be in court at a later date, which has not been determined.

Elbridge (WSYR-TV) - The men who police say lit a cat on fire, killing it, were in Town of Elbridge court this afternoon, and face new charges, unrelated to the cat case. 20 year old Dustin Gauger and 18 year old Kyle Custer were appearing on rape charges.

The men face one count of second degree rape and one count of endangering the welfare of a child. Police say they were having sex with two 14 year old girls.

The alleged incident happened a few weeks ago, according to State Police.

Custer was arraigned. Gauger's attorney was not present, and he was presented with the charges, but not arraigned. Orders of protection have also been issued on Gauger and Custer. Both have been remanded to Onondaga County Justice Center on $15,000 cash/$30,000 bond bail.

They are also accused of stealing the cat from a home in the Village of Elbridge and taking it to the mobile home park where they live.

Police say that's when they doused the cat with gasoline and set it on fire.

Their charges of petit larceny and aggravated cruelty to animals from that incident still stand.

Elbridge (WSYR-TV) - State Police say two Elbridge men stole a cat, tied it up, doused it in gasoline, and lit it on fire at the Champion Trailer Park in Elbridge on Wednesday night. The cat died from its injuries.

State Police say the two men, 20-year-old Dustin Gauger and 18-year-old Kyle Custer of Lot 241 Champion Trail Park, stole the cat from a Village of Elbridge residence.

Then, the two men took the cat back to the trailer park, where they tied it up, doused it with gasoline, and lit it on fire. After being lit on fire, the cat ran into a car cover setting, which was also set on fire. Neighbors saw the fire and called 911.

Gauger and Custer are charged with petit larceny and aggravated cruelty to animals. Custer faces an additional charge of unlawful possession of marijuana.

State Police say the cat was severely burned, and later died from its injuries.

Both Gauger and Custer have been arraigned in Town of Camillus Court, and sent to the Onondaga County Justice Center in lieu of $5,000 cash/$10,000 bond bail. Police say more charges are likely.
